Basic provisions

Questions not regulated in these Regulations, as well as the interpretation of these Regulations, are governed by Hungarian law, in particular Act V of 2013 on the Civil Code (“Civil Code”) and on certain issues of electronic commercial services and services related to the information society CVIII of 2001 the relevant provisions of the law. The mandatory provisions of the relevant legislation apply to the parties without special stipulations.

The scope of these Terms and Conditions covers all electronic services provided in the territory of Hungary, which are provided through the use of the Service.

Definition of basic terms

·        Content – audio, video, images, flash or any other data displayed by the Client based on the Client’s ideas and concepts. The concept of content does not include the program that operates the page system and its source code written in some programming language.
·        Individual website – a website whose content can be searched on the Internet using a browser program at the Internet address requested/marked by the Client.
·        Source code – the computer program, programming language that operates the site system, which is the property of the Trustee.
·        Source code user – the natural or legal person who, based on a mutual agreement between the Principal and the Principal, is authorized to use the source code of the site system by the Principal or the maintainer of the website.
·        Basic material – Content that the Client mentions in the image design work phase, the Client made available to the Client.

The service company provides services related to website and webshop creation, online image and graphic design, website maintenance, and website development training.

With the help of the Website, Users can sign up for consultations related to online appearance and website design, order website/webshop creation, maintenance, training, services related to online image design, use services related to online appearance, marketing consulting, and participate in workshops.

They can take part in workshops and group events organized by the entrepreneur, and they can buy and download the publications published on the website.

Intellectual Property Rights

The Service Provider grants the User a non-exclusive, non-transferable and limited right of use to view the content of the Service. The User may use the Service and its content only in accordance with the Agreement and for their own personal use.

The materials on the website and the content of the Service are subject to the copyright law, the trademark law and other laws on the protection of intellectual property rights. The Agreement concluded with the Service Provider in no way confers on the User any ownership rights or any other intellectual property rights relating to the content of the Service or the Service.

Information on prices and invoicing

Due to the nature of the service, the individual service price information appearing on the website is only indicative. All clients and contracts are accepted upon acceptance of an individual quote.

Differently from this, fixed-price products or services may appear on the website, these are indicated in a separate information sheet in their description. An example of this is the pre-announced price on the order and application forms.

The service provider is a Taxpayer Subject, and therefore the prices shown are gross prices, calculated with a 0% tax rate.

In accordance with the current legislation, an electronic invoice will be issued for the order, which will be sent to the e-mail address specified at the time of the order.

By accepting these general terms and conditions, the Customer consents to the fact that Judit Erika Sóki, tax payer ev. issue him an electronic invoice.

Adoption of the document, CXXVII of 2007. in accordance with the provisions of § 175 of the Act, it is considered the consent of the recipient of electronic invoices.

The User is solely responsible for the accuracy, timeliness and truthfulness of the data provided. The Service Provider excludes all liability arising from the incorrectness, typos or incorrect data provided on the Website.

The Service Provider shall not be held liable for service inaccuracies, delays, or other problems or errors that can be traced back to wrongly and/or inaccurately provided data by the User.

The Service Provider reserves the right to accept the User’s request for an offer or to reject it without justification.

The service provider confirms the order/request for quotation by e-mail.

Description of payment options and delivery methods

After finalizing the order, the price of the products ordered on the website can be settled with the following payment methods:

Bank transfer on the basis of fee request/advance account/invoice.

With the exception of products that can be downloaded for free or services that can be used for free, the ordered product/service can only be used/downloaded/delivered after the payment of the price of the product/service.

The prices displayed for the product/service are gross prices. The service provider is a tax-exempt low-tax entrepreneur.

The prices of any additional services may also be detailed in the displayed price.

In accordance with the current legislation, an electronic invoice will be issued for the order, which will be sent to the e-mail address specified at the time of the order. We are unable to issue a paper-based invoice.

By accepting these general terms and conditions, the Buyer consents to the fact that Judit Erika Sóki ev. issue him an electronic invoice.

Adoption of the document, CXXVII of 2007. in accordance with the provisions of § 175 of the Act, it is considered the consent of the recipient of electronic invoices.

Processing and fulfillment of orders/requests for offers

Orders/requests for offers are processed on working days from 8 a.m. to 3 p.m.

It is also possible to send orders/requests for offers outside of the indicated times, if they are done after the end of working hours, they will be processed on the following working day.

Regarding the individual offer request service, the Service Provider prepares an individual offer, which after acceptance by the Customer, the Service Provider issues the electronic invoice, which is sent to the Customer by e-mail. You can start using the service after paying the bill. Some cases may differ from the above, this is fixed by a case-by-case and individual agreement between the Service Provider and the Customer.

If the Service Provider does not fulfill its obligations under the contract because the product/service specified in the contract is not available, it is obliged to inform the User immediately and refund the amount paid by the User immediately, but no later than within thirty days. Fulfilling this obligation does not exempt the Service Provider from other consequences of breach of contract.

Right of withdrawal

Governing legislation:

The consumer is not entitled to the right of withdrawal and termination in all cases, since a

§ 29 of the Government Decree – in the absence of a different agreement of the parties regarding certain products – excludes the exercise of this right in relation to the following services and products:

Absence of the right of termination in the case of a contract for the provision of services

In the case of a contract for the provision of a service, after the completion of the service as a whole, if the company began the performance with the express, prior consent of the consumer, and the consumer acknowledged that he loses his right of termination after the completion of the service as a whole.

Absence of the right of withdrawal or cancellation in the case of a non-pre-manufactured product that was produced based on the instructions or at the express request of the consumer, or in the case of a product that was clearly tailored to the consumer.

The scope of this exception rule includes products that are tied to the person of the consumer, or manufactured in a customized manner based on the consumer’s individual instructions or at the express request of the consumer.

With regard to digital data content provided on a non-material data carrier, if the business has started performance with the express, prior consent of the consumer, and the consumer has simultaneously declared with this consent that he/she will lose his/her right of withdrawal/termination after the start of performance.

For example, games, music, wallpaper, etc. that can be purchased (downloaded) from the Internet.

In case of registration for courses, workshops, or other courses, cancellation or modification is possible 48 hours before the start time (that is, until the 2nd day before the start).

In the case of consulting services, cancellation is possible 48 hours before the start time (that is, until the 2nd day before the start).

In the case of design, image and style design, web design, cancellation is possible 48 hours before using the service (that is, until the 2nd day before the start).

If the service has already been partially used, i.e. the planning task has begun, the Customer is obliged to pay the fee for the service in part.

Fuse

The User may not act in a way that prevents, overloads, damages or impairs the operation of the Service or the Website. In addition, the User may not interfere with the use of the Service by other users.

The User may not attempt to access networks, computer systems, content or information connected to the Website or the Service without permission.

Links on the Website

The Website may contain Internet links to websites operated by third parties. The Service Provider has no influence on such links or the content of the relevant websites and assumes no responsibility for them. The User is entitled to visit such websites at his own risk.

Liability for damages

The User undertakes to compensate the Service Provider, its employees and contractual partners for all damages incurred due to or in connection with the User’s violation of the Contract or the User’s violation of the applicable laws or the User’s violation of the rights of any third party.

Limitation of liability, malfunctions and outages

Any breakdown, outage or other error in the Service must be reported to the Service Provider as soon as possible.

To the maximum extent permitted by law, the Service Provider excludes its responsibility for errors in the Service that are outside the scope of the Service Provider’s interests, such as, for example, in the case of other errors that occurred because the User uses an inappropriate device, or that occur to the User can be blamed. Force majeure is a reason beyond the scope of the Service Provider’s interests.

The Service Provider informs Users that three types of maintenance may occur:

Monthly planned maintenance
Unscheduled maintenance
Emergency maintenance: This can take place at any time in any time interval, if an urgent technical problem occurs, which fundamentally endangers the operation of the Service.

The Service is not available during the above-mentioned maintenance.

Warranty

The service provider assumes responsibility for ensuring that the service it provides fully complies with the quality agreed in the contract, at the highest level that can be expected, and is free of professional errors.

Warranty, guarantee

Products with a sales price of HUF 10,000 or less are not subject to a mandatory warranty – based on the law – but the manufacturer or distributor may undertake a voluntary warranty, and the consumer is entitled to accessory warranty rights.

If the customer cannot use the provided service for reasons beyond the service provider’s control, additional professional support can be provided based on consultation.

Complaint handling

In the event of a complaint, complaint or data entry error that may arise during the use of the Service, the Service Provider

Complaint handling by the Service Provider is always free of charge.

The service provider will immediately examine the problem that requires an immediate solution and, if possible, remedy it immediately, and in all other cases, respond to the complaint within 24 hours.

If the problem cannot be solved in any other way, the Service Provider may contact the User by telephone.

If the User’s complaint is rejected in whole or in part, or if the deadline set above for the investigation of the complaint has passed without result, the User may contact the following authorities and bodies:

Miscellaneous Provisions

The Service Provider and the User try to settle their disputes amicably. The User and the Service Provider stipulate the jurisdiction of the Pécs Bíróság/Törvényszék for potential disputes that cannot be settled within 30 (thirty) calendar days within the scope of these Regulations.

The security level of the website operated by the service provider is adequate, but we recommend that you take the following precautions: use virus and spyware protection software with an up-to-date database, install security updates for your operating system. The use of the Website presupposes the User’s knowledge of the technical and technical limitations of the Internet and acceptance of the potential for errors associated with the technology.

The Service Provider is not responsible for any damage that occurred due to the connection to the Website. The Customer is responsible for protecting his computer and the data on it.

It is expressly forbidden to forward, communicate, or share content that is not legally permitted on the Website. The Service Provider reserves the right to delete content uploaded by Users.

The contract can be terminated by both the User and the Service Provider without reason, by sending an e-mail to the User or to Customer Service.

The service provider submits to the provisions of the code of ethics, which can be read in a separate menu item.

The service provider is entitled to unilaterally modify the terms of these GTC at any time. The possible modification will enter into force at the same time as it appears on the Website.

Concept:

A general contract term is a contract term that is unilaterally determined in advance by the user for the purpose of concluding several contracts, without the involvement of the other party, and that was not individually negotiated by the parties.
